CLEVELAND -- A judge in Cleveland wants to hear from both sides in a retired autoworker's bid to overturn the ruling that led to his deportation to Germany and conviction on Nazi war crimes charges.

Federal Judge Dan Polster directed the government on Thursday to submit legal briefs by Aug. 19, 2011 in the case of John Demjanjuk of Seven Hills. His attorneys have until Sept. 2, 2011 to respond.

Demjanjuk's attorneys charge that the government failed to disclose important evidence.

They cited a 1985 secret FBI report uncovered by The Associated Press. It indicated the FBI believed a Nazi ID card purportedly showing Demjanjuk served as a death camp guard was a Soviet fake.

The 91-year-old Demjanjuk was convicted in Germany on May 12, 2011 on 28,060 counts of accessory to murder.
