************************************************************************** Will Zuzak; DEMANUK.015 = April 1994 update; 1994-04-22 ************************************************************************** Dear subscribers: A quick update summary on the Demjanjuk/war crimes issue: (1) In a telephone call last Wednesday night, Ed Nishnic states that things are strangely quiet in the Demjanjuk case. The OSI has not yet appealed to the Supreme Court the "prosecutorial misconduct constituting fraud on the court" ruling of the Sixth Circuit Court. Judge Battisti has not yet responded to submissions of the Demjanjuk defense, that he overturn his 1981 denaturalization judgement and dismiss the OSI demand that Demjanjuk prove his innocence. (2) Neal Sher has stepped down as director of the OSI and is now heading up Israel's main lobby AIPAC (American-Israel Public Affairs Committee). Eli Rosenbaum(?) is now the head of the OSI. (3) The April 3, 1994 issue of the Ukrainian Weekly contains an "Open letter from Demjanjuk defense" explaining the situation and appealing for funds. (4) The April 4, 1994 issue of the Ukrainian Voice has reprinted a letter by Eugene Roslycky from the Monday, January 3, 1994 issue of the London, Ont., Free Press concerning the John Demjanjuk case. Prof. Roslycky submitted the article to several Canadian newspapers back in August, 1993 but was refused publication until finally the London Free Press relented. (5) A rather long article in the April 11, 1994 issue of the Ukrainian Voice titled "Ukrainian Canadian Civil Liberties Assoc." and subtitled "action note: war crimes" emphasizes the difference between the Canadian war crimes legislation under rigorous criminal rules of evidence and the American OSI lax civil procedures consisting of denaturalization and deportation. It highlights the case of John Demjanjuk as "an example of what goes wrong" under OSI procedures. The article concludes with the following two paragraphs: --------------------------------------------------------------------------- "There has been continuing pressure to introduce the American system, because the standard of proof is so much lower than required by Canada's war crimes legislation. If the policy is changed, any immigrant to Canada who concealed his place of birth to save his relatives from harm can, and will, be denaturalized and deported. The Minister of Justice, Allan Rock, has confirmed articles in the media that the government is planning to abandon the Canadian system and adopt the American one in dealing with war criminals. Write to the government and your member of parliament that you oppose denaturalization and deportation and support trying alleged war criminals in Canada's criminal courts. Write to: The Rt. Hon. John Chretien Prime Minister Ottawa, Canada K1A 0A6 and (name of member of parliament), M.P. House of Commons Ottawa, Canada K1A 0A6 If you live in the Justice Minister's constituency, write to: Hon. Allan Rock, M.P. Minister of Justice and Attorney General for Canada Constituency Office 2940A Bloor Street West Etobicoke, Ontario M8X 1B6 --------------------------------------------------------------------------- I hope to be able to post telephone, fax and Email numbers of relevant bureaucrats and politicians at a later date. *************************************************************************** Will Zuzak; DEMANUK.015 = April 1994 update; 1994-04-22 ***************************************************************************
